Terms of Use
A clear working agreement.
Effective September 2, 2026.
These terms govern access to and use of the Swiex iOS application.
Acceptance
By downloading, installing, or using Swiex, you agree to this Use Charter. If you do not agree, do not use the application.
You must have authority to accept these terms for yourself or for the organization on whose behalf you use Swiex.
Purpose and eligibility
Swiex is a production continuity tool intended for users who are legally able to enter a binding agreement. It supports record keeping and visual review for film, television, stage, commercial, and related production work.
License
Subject to these terms, you receive a limited, personal, non-exclusive, non-transferable, and revocable right to install and use Swiex on Apple devices that you own or control, as permitted by the rules of the distribution platform.
You may not copy, sell, rent, sublicense, reverse engineer, bypass safeguards, or create a derivative work from Swiex except where applicable law expressly permits it.
Your production content
You retain your rights in project information, notes, photos, annotations, and other materials you place in Swiex. These terms do not transfer ownership of that content to the Swiex operator.
You are responsible for ensuring that you have permission to capture, store, annotate, export, and share production content, including materials that show performers, crew members, costumes, props, artwork, confidential sets, or protected designs.
Responsible use
You agree not to use Swiex to:
- violate law, contract, intellectual property rights, privacy rights, or production rules;
- capture or distribute material without required permission;
- introduce malicious code or interfere with the application's operation;
- misrepresent records, approvals, identities, or production authority; or
- attempt to defeat device, application, or distribution-platform security.
Production decisions
Swiex is an organizational aid. It does not replace the judgment of a script supervisor, department head, producer, safety professional, rights holder, or other responsible crew member. You must verify continuity, approvals, safety, permissions, and production decisions independently.
Exports and imports
You control project package and report exports. Before sharing, verify the recipient, destination, and contents. Imported packages may contain material supplied by another person; you are responsible for confirming that you are authorized to use it.
Maintain independent backups when production policy requires them. The Swiex operator is not responsible for copies managed by another application, service, recipient, or storage destination.
Feature availability
Features may depend on device capabilities, iOS permissions, storage capacity, and operating-system behavior. The application may be updated, improved, replaced, or discontinued as permitted by law.
All features in the current version are available without an in-app purchase. Any future commercial terms will be presented before they apply.
Intellectual property
Swiex, its interface, code, structure, and original materials are protected by intellectual property laws. Apple and Apple product names are trademarks of Apple Inc. Other names belong to their respective owners.
Warranty disclaimer
To the maximum extent permitted by law, Swiex is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, or error-free results. Rights that cannot lawfully be excluded remain unaffected.
Limitation of liability
To the maximum extent permitted by law, the Swiex operator will not be liable for indirect, incidental, special, consequential, exemplary, or production-loss damages arising from use of or inability to use Swiex, including loss of content, schedule disruption, reshoots, replacement costs, lost revenue, or lost opportunity.
Any liability that cannot be excluded or limited remains subject to the protections required by applicable consumer law.
Termination
Your right to use Swiex ends if you materially breach these terms. You may stop using the application at any time. Provisions concerning ownership, responsibility, disclaimers, liability, and interpretation survive termination where their nature requires it.
Apple platform terms
If you obtained Swiex through Apple's App Store, Apple is not responsible for maintaining or supporting Swiex except as required by law. Apple is a third-party beneficiary of these terms and may enforce the provisions that apply to it. Your use of the application must also comply with applicable Apple media-service rules.
Changes and interpretation
These terms may be updated to reflect feature, legal, or operational changes. The effective date identifies the current version. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver.
